Terms & Conditions

Effective Date: December 2025

By placing an order, submitting payment, signing an invoice or reservation agreement, or accepting delivery of rental equipment, the customer ("Renter") agrees to these Terms & Conditions, which form a legally binding contract with Superstar Party Rentals ("Company").

1. Payment Terms

A 25% non-refundable booking deposit and signed agreement are required to reserve equipment.
The remaining balance is due prior to delivery or setup. Equipment will not be released without full payment.
Applicable California sales tax is charged based on delivery location. Valid resale certificates must be submitted in advance for tax exemption.

2. Cancellations & Restocking Fees

If a reservation is canceled, the following fees apply to cover labor, scheduling, and inventory allocation:

30–7 days before delivery: 25% restocking fee
Within 7 days of delivery: 50% restocking fee
Within 24 hours of delivery: 100% of rental charges

Once a reservation is confirmed, equipment is removed from availability and held exclusively for the Renter.

3. Tent Rentals & Weather Conditions

Tents are temporary structures and are subject to weather and site conditions.

Renter assumes responsibility for monitoring weather and safety conditions.
Accurate underground utility markings must be provided prior to installation.
Permits, engineering approvals, or venue requirements are the Renter’s responsibility.
Tent reservations may be subject to separate cancellation or weather-related policies.

4. Reservation Accuracy

Renter is responsible for reviewing all reservation details including dates, quantities, layout, access points, and site conditions. Changes requested after confirmation may result in additional fees.

5. On-Site Changes

Any changes requested during delivery or setup must be approved by the Renter or authorized representative. Additional labor, equipment, or transport charges may apply and will be added to the final invoice.

6. Labor Charges

Labor costs are estimated based on the information provided at booking. Additional labor caused by site conditions, delays, or inaccurate information may be billed at the Company’s standard rates.

7. Delivery Access & Site Conditions

Renter must ensure clear, safe access to the delivery and setup location. If delivery or installation cannot be completed due to access issues, inaccurate information, or unsafe conditions, no refunds will be issued.

8. Receipt, Inspection & Return of Equipment

Renter or authorized agent must inspect equipment upon delivery. Any discrepancies must be reported within two (2) hours.
Renter is responsible for equipment from delivery until pickup.
Equipment must be returned in the same condition as delivered, normal wear and tear excepted.
Charges may apply for damage, loss, excessive cleaning, or late returns.

9. Authorization to Charge Card on File

By providing a credit or debit card, Renter authorizes the Company to charge the card on file for:

Remaining balances or unpaid invoices
Approved extensions or additional rental time
Damage, loss, theft, or excessive cleaning
Late fees or collection-related charges

Such charges may occur after the event where applicable. Invoices, emails, text messages, and booking confirmations constitute written authorization.

10. Payment Defaults & Late Fees

Declined or failed payments do not release the Renter from payment obligations.
Balances unpaid more than 30 days after the event may accrue a 1.5% monthly late fee, compounding every 30 days until paid.
Renter agrees to pay reasonable collection and administrative costs.

11. Pricing Transparency & Fees

All mandatory charges are disclosed prior to payment. Any applicable processing or convenience fees are presented before checkout. Alternative payment methods may be available upon request.

12. Chargebacks & Disputes

Renter agrees to contact Superstar Party Rentals directly to resolve billing concerns prior to initiating a chargeback. Chargebacks submitted in violation of these Terms may result in responsibility for chargeback fees and administrative costs.

13. Assumption of Risk & Liability

Renter assumes all risks associated with the use, operation, and placement of rented equipment. The Company is not liable for injury, loss, or damage arising from improper use, weather conditions, or site-related issues beyond its control.

14. Indemnification

Renter agrees to indemnify and hold harmless Superstar Party Rentals from all claims, damages, losses, costs, and expenses, including reasonable attorney’s fees, arising from use of the rented equipment.

15. Limitation of Liability

The Company shall not be liable for indirect, incidental, special, or consequential damages. Total liability shall not exceed the rental fees paid. Any legal action must be initiated within one (1) year of the event date.

16. Force Majeure

Superstar Party Rentals is not responsible for failure or delay caused by events beyond its reasonable control, including but not limited to severe weather, natural disasters, or government actions.

17. Permits & Compliance

Renter is responsible for obtaining any required permits or approvals. The Company is not responsible for determining permit requirements.

18. Proposition 65 Notice

Some rental products may contain chemicals known to the State of California to cause cancer or reproductive harm.

19. Attorney’s Fees & Non-Waiver

In any legal action arising from these Terms, the prevailing party shall be entitled to reasonable attorney’s fees and costs. Failure to enforce any provision does not constitute a waiver.

20. Governing Law & Entire Agreement

These Terms are governed by the laws of the State of California. They constitute the entire agreement between the parties and supersede all prior communications. Modifications must be in writing and signed by an authorized Company representative.

By submitting payment, the Renter acknowledges they have read, understood, and agreed to these Terms & Conditions.
