TERMS AND CONDITIONS
Payment Terms
To secure your reservation, a signed Rental Agreement and a 25% deposit are required. The remaining balance is due upon delivery, prior to installation/setup. Under California state law, Superstar Party Rentals may be required to collect sales tax based on the delivery location. Renters holding valid California resale certificates must provide this information in advance if they wish to be exempt from sales tax.
Cancellation Fees
If you need to cancel your order, the following fees apply to cover Superstar Party Rentals’ time, resources, and expenses:
a. Once the reservation is confirmed by your signature, the Rental Agreement is binding. All reserved items are held exclusively for you and unavailable to others.
b. Cancellations made between 30 and 7 days before the scheduled delivery date will incur a 25% restocking fee.
c. Cancellations made within 7 days of the delivery date will incur a 50% restocking fee.
d. Cancellations made within 24 hours of delivery will incur a 100% restocking fee.
Tent Rentals
Tents are temporary structures and may not withstand extreme weather or other unforeseen conditions. Even if properly installed, they can become unsafe due to wind, rain, lightning, earthquake, or similar events. The Renter is responsible for monitoring weather and conditions and determining whether to evacuate the tent area if necessary. The Renter must provide Superstar Party Rentals with accurate maps showing all underground utilities and designate the location of any installations that could interfere with tent placement. Local building codes and regulations vary; Superstar Party Rentals will make reasonable efforts to comply but may require additional rental charges for compliance. The Renter may provide any required permits or engineering documentation in advance. Please note that tent cancellations may follow a different fee schedule than other rentals.
Reservation Agreement Accuracy
It is the Renter’s responsibility to review all details in the Reservation Agreement, including event dates, times, delivery locations, and quantities of requested items. Any necessary changes or missing information should be communicated to Superstar Party Rentals before the scheduled shipment/delivery/installation date. Additions or modifications requested within three business days of the event may be considered “rush/change” orders and could incur additional fees.
On-Site Changes
Any changes or additions to the rental items or services made during on-site installation must be approved by the Renter or their authorized representative. Such changes are subject to item availability and may result in additional fees, including labor and transportation. These adjustments will be reflected in the final post-event invoice.
Costs of Labor
Superstar Party Rentals estimates labor costs for delivery, setup, and removal based on the details provided by the Renter and the agreed-upon schedule in the Rental Agreement. Actual labor costs may vary if delays, changes, or other unforeseen circumstances arise. Any additional labor expenses will be reflected in the final post-event invoice.
Venue Access
The Renter must ensure that all rented items fit into the designated delivery and installation areas. If an item cannot be delivered or installed due to venue constraints (doorways, elevators, stairwells, etc.), the Renter remains responsible for the agreed-upon rental charges. No refunds will be issued for items deemed unusable due to accessibility issues.
Receipt of Property
The Renter or their authorized agent must inspect and sign for all rental items upon receipt (will call or delivery). Any discrepancies or issues must be reported to Superstar Party Rentals within two hours. Failing to report problems within this timeframe indicates acceptance of all items as delivered.
Return of Property
All rental items must be returned in their original condition by the agreed return date. The Renter is liable for any damage, loss, or required repairs. Items not returned on time or in acceptable condition may incur prorated daily rental charges until resolved.
Assumption of Risk, Release of Liability
The Renter acknowledges that using, transporting, and operating rental items involves inherent risks. By renting from Superstar Party Rentals, the Renter assumes all such risks and releases Superstar Party Rentals from any liability for related injuries, damages, or losses.
Indemnity/Hold Harmless
The Renter agrees to indemnify and hold Superstar Party Rentals harmless from any claims, damages, liabilities, costs, and expenses (including attorney’s fees) that arise from the use, installation, maintenance, or operation of the rental items.
Limitation of Liability
Under no circumstances shall Superstar Party Rentals be liable for indirect, special, incidental, consequential, or punitive damages, or for any costs related to procuring substitute products or services. Superstar Party Rentals’ total liability shall not exceed the rental fees paid. Any legal action for breach of this Agreement must be initiated within one year of the cause of action.
Force Majeure
Superstar Party Rentals is not responsible for performance delays or failures caused by events beyond its reasonable control, including but not limited to war, terrorism, strikes, embargoes, riots, power outages, equipment failures, government restrictions, fires, floods, severe weather, earthquakes, or other acts of God.
Payment
If a credit card company declines payment, the Renter remains fully liable for the outstanding balance. Invoices not paid within 30 days beyond the event date (40 days total) may incur a 1.5% monthly late fee. Additional late fees may compound every 30 days until payment is received.
Use, Permits, Etc.
The Renter agrees not to use or allow the use of rental items in an illegal or unsafe manner. The Renter is responsible for obtaining and paying for any required permits, licenses, or authorizations related to the use of the rental items. Superstar Party Rentals is not responsible for determining if such permits or licenses are needed.
Non-Waiver
If Superstar Party Rentals does not enforce any provision of these Terms and Conditions or the Rental Agreement, it does not waive the right to enforce that provision at a later time.
Proposition 65 Warning
Some rental items may contain chemicals known to the State of California to cause cancer, birth defects, or other reproductive harm.
Attorney’s Fees
If any legal action is taken arising from this Agreement, the unsuccessful party shall pay the prevailing party’s reasonable attorney’s fees and related costs.
Entire Agreement
By signing, the Renter acknowledges having read, understood, and agreed to these Terms and Conditions and any additional conditions posted on SuperstarPartyRentals.com. Together, these documents form the entire agreement between the parties, superseding any other written or oral representations. In case of any conflict between these Terms and Conditions and other documents, these Terms and Conditions shall prevail. No modification is valid unless signed by an authorized representative of Superstar Party Rentals.
